Tradie Card Terms of Service

These Terms govern access to and use of Tradie Card, including account services, public business profiles, lead capture, and subscription billing.

Tradie Card is operated by ABK Digital (ABN 73 674 188 619) in New South Wales, Australia.

By creating an account, publishing a profile, purchasing a subscription, or otherwise using Tradie Card, you agree to these Terms.

If you do not agree with these Terms, do not use the platform.

1. Platform Operator and Acceptance

These Terms apply to all users of Tradie Card, including account holders, businesses, and visitors to public business pages.

You are responsible for ensuring anyone using Tradie Card on your behalf also complies with these Terms.

2. Eligibility and Accounts

You must have legal capacity to enter into a binding contract to use Tradie Card. If you use Tradie Card for a business, you confirm you are authorised to act for that business.

  • Keep your login credentials secure and confidential.
  • Provide accurate and current account information.
  • Promptly update details that become inaccurate or out of date.
  • You are responsible for activity under your account unless caused by our breach.

3. Business Data and ABN Obligations

Tradie Card is built for Australian local service businesses. You must provide truthful business details, including a valid ABN and accurate contact details.

You are responsible for all content you publish, including services, pricing cues, images, descriptions, social links, and business claims.

4. Subscription, Fees, and Billing

Tradie Card is sold as a recurring subscription with monthly and annual billing options. Pricing and plan details shown at checkout form part of these Terms.

  • Subscriptions renew automatically until cancelled.
  • A 7-day trial may be offered to eligible first-time subscribers, as stated at checkout.
  • An active paid subscription is currently required before first-time profile publication.
  • You can manage cancellation and billing details through the Stripe billing portal linked from your dashboard.
  • Fees are non-refundable unless required by Australian Consumer Law or another non-excludable law.

5. Stripe Payment Services

Stripe provides payment processing and billing portal services for Tradie Card subscriptions. By paying through Tradie Card, you also agree to Stripe's terms and privacy policy as they apply to payment processing.

Tradie Card does not store full card numbers or card security codes.

6. Profile Publication and Availability

Published business pages are publicly accessible and may be indexed by search engines. You are responsible for information made public through your profile.

We may change, suspend, or remove features or profile availability where necessary for safety, legal compliance, product integrity, non-payment, or operational reasons.

7. Lead Enquiries

Tradie Card routes enquiries from public business pages into account lead records. You are responsible for how you respond to enquiries and for complying with applicable law when using customer contact information.

Tradie Card does not guarantee lead volume, lead quality, conversion rates, business outcomes, or search ranking position.

8. Your Content and Licence to Operate the Service

You retain ownership of content you provide to Tradie Card.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, and distribute your content as required to operate, secure, and improve Tradie Card.

9. Acceptable Use

You must not use Tradie Card for unlawful, abusive, deceptive, or harmful conduct.

  • No false business identity, impersonation, or fraudulent ABN use.
  • No unlawful or infringing content.
  • No security abuse, malware, scraping at abusive scale, or unauthorised access attempts.
  • No deceptive lead collection or misleading representations to customers.

10. Third-Party Services and External Links

Tradie Card depends on third-party services including Firebase/Google Cloud and Stripe. We are not responsible for outages or acts of third-party providers beyond our reasonable control.

Public profiles may include links to third-party websites. We are not responsible for content or practices on external websites.

11. Platform Intellectual Property

Tradie Card software, branding, design assets, and platform materials (excluding your content) are owned by us or our licensors and are protected by applicable intellectual property laws.

You may use Tradie Card only as permitted by these Terms and must not copy, reverse engineer, or exploit platform code or brand assets without permission.

12. Suspension and Termination

We may suspend or terminate access where there is non-payment, suspected fraud, legal risk, safety risk, infringement, or breach of these Terms.

To request account closure support, contact hello@tradiecard.au. Certain records may be retained where legally required or reasonably needed for fraud prevention, accounting, and dispute resolution.

13. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Where a statutory guarantee applies, our liability is limited to the extent permitted by law.

14. Disclaimers

To the extent permitted by law, Tradie Card is provided on an as-is and as-available basis. We do not promise uninterrupted availability, error-free operation, or specific business outcomes.

15. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, including lost profits, lost opportunities, or loss of data arising from use of Tradie Card.

Where liability cannot be excluded, our liability is limited to the remedies permitted by applicable law.

16. Indemnity

You indemnify us against reasonable loss, damage, and costs resulting from your unlawful use of Tradie Card, your breach of these Terms, or your infringement of third-party rights.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.

You and we submit to the non-exclusive jurisdiction of the courts of New South Wales for disputes arising out of or in connection with these Terms.

18. Changes to These Terms

We may update these Terms from time to time. If we make material updates, we will update the Last Updated date and provide notice where required by law.
